SKUE Seller Terms of Service
These Seller Terms of Service ("Agreement") govern your use of the SKUE platform as a seller. By creating a seller account or listing products on SKUE, you agree to the terms below.
1. Eligibility & Acceptance
You must be a registered business in Canada or an individual legally allowed to sell goods. By using SKUE as a seller, you confirm that all information you provide is accurate and that you agree to comply with Canadian federal and provincial laws. All sellers must be Canadian businesses, and products must be manufactured, formulated, or assembled in Canada. Products using foreign-sourced ingredients or materials are permitted only if the final product is made or packaged in Canada.
2. Seller Account Setup
To list products, you must:
Create a seller account
Provide accurate business, tax, and banking information
Maintain your account details up to date
SKUE reserves the right to approve or reject seller applications at its discretion.
3. Product Listings & Accuracy
You are solely responsible for:
Creating accurate and truthful product listings
Including clear pricing, shipping timelines, and product specifications
Ensuring all products are Canadian-made, Canadian-branded, or eligible under SKUE’s listing criteria
4. Order Fulfillment & Shipping
You agree to:
Promptly fulfill all orders received through SKUE
Provide tracking information where applicable
Ensure reasonable shipping times and transparent policies
5. Returns, Refunds & Customer Service
Sellers are required to:
Maintain a clear return and refund policy
Respond to customer inquiries within 48 hours
Resolve disputes professionally and in good faith
6. Fees & Commission
SKUE currently charges no listing fees. A commission will be applied to each sale, communicated to you in advance. Fees may change with notice.
7. Use of SKUE’s Platform & Tools
Sellers may use integrated tools such as Shopify sync, product importers, and analytics dashboards. Misuse of these tools or attempting to bypass the SKUE system may result in account suspension.
8. Compliance with Canadian Law
You are responsible for ensuring that your products and business practices comply with:
Canadian Consumer Protection laws
Labeling, packaging, and safety regulations
Any applicable e-commerce tax requirements
9. Intellectual Property
You may not list counterfeit or unauthorized products. You affirm that you have the rights to sell all products listed. SKUE may remove listings in response to IP complaints.
10. Termination
We’re not another marketplace trying to be everything for everyone.
We’re building a focused platform where Canadian brands can finally be seen, supported, and succeed without being buried under global listings or punished by high fees.
11. Limitation of Liability
SKUE is not liable for any loss, damages, or legal claims related to your products or conduct. Our liability to you is limited to the amount of commission earned by SKUE from your sales over the past 3 months.
12. Modifications to Terms
We may modify these terms at any time. Continued use of SKUE as a seller constitutes acceptance of the updated terms.
13. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
14. Tax Collection & Remittance
SKUE, as a Marketplace Facilitator, collects and remits all applicable GST/HST/QST on transactions made through the SKUE platform. Sellers will receive the net proceeds of their sales (excluding tax) minus SKUE’s commission. This applies regardless of whether the seller is registered for GST/HST. Sellers are responsible for reporting their income and understanding their tax obligations with the CRA.
